1. Acceptance of Terms

By accessing or using PlugAndClaw ("the Service"), operated by PlugAndClaw ("we", "us", "our"), available at plugandclaw.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

PlugAndClaw provides managed hosting for OpenClaw, an open-source AI assistant platform. Each subscriber receives a dedicated cloud server running OpenClaw, pre-configured with AI models (Claude, GPT, Gemini, Kimi, Minimax) and accessible via Telegram and the browser-based Control UI.

The Service is built on top of OpenClaw (MIT licensed, open source). We do not develop the underlying AI models — they are provided by Anthropic, OpenAI, Google, MoonshotAI, and Minimax, routed via OpenRouter.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To use the Service, you must create an account using Google Sign-In. You are responsible for:

Providing accurate account information
Maintaining the security of your account credentials
Keeping your gateway token and Telegram bot token confidential
All activity that occurs under your account

You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions, Credits & Billing

The Service is offered on a subscription basis. Current pricing is available on our website at the time of purchase. Each subscription includes a monthly AI credit allowance, as stated on our pricing page.

Credits are deducted based on actual AI usage (tokens processed) at provider rates
Unused credits do not roll over — they expire at the end of each billing cycle
Additional credits may be purchased at cost with no processing fees
When credits are exhausted, your assistant will pause until you top up or your billing cycle renews
All payments are processed securely by Stripe

Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date. You may cancel your subscription at any time through Stripe or by contacting support. Cancellation takes effect at the end of the current billing period.

We reserve the right to modify pricing with 30 days' notice. Existing subscribers will be notified via email before any price changes take effect. Continued use after a price change constitutes acceptance of the new pricing.

7. Your Server & Data

Each subscriber gets a dedicated cloud server. Your server is isolated from other users — no shared resources, no shared data. You have full control over your assistant's configuration, personality, and workspace.

Your conversations, memory files, and workspace data are stored on your dedicated server with encryption at rest. We have administrative SSH access to your server for maintenance, support, and security purposes.

You may also configure your own API keys (Bring Your Own Key) for direct access to AI providers, bypassing our proxy. Keys you add are stored only on your server.

8. Data Backup — Your Responsibility

We do not perform backups of your server, workspace, or data. If data is lost — whether due to accidental deletion, AI error, server failure, or any other reason — we cannot recover it.

We strongly recommend:

Push code and projects to GitHub, GitLab, or another version control service
Sync important files to cloud storage (Google Drive, Dropbox, etc.)
Regularly export any data you cannot afford to lose

Your AI assistant has the ability to create, modify, and delete files in its workspace. Plan accordingly.

9. Acceptable Use Policy

You agree NOT to use the Service to:

Violate any applicable laws, regulations, or third-party rights
Generate illegal, harmful, abusive, or exploitative content
Harass, threaten, impersonate, or harm others
Send spam, unsolicited messages, or engage in abusive behaviour through deployed bots
Distribute malware, harmful code, or engage in phishing or social engineering
Attempt to bypass usage limits, security measures, or rate limits
Resell, redistribute, or sublicense the Service without prior written consent
Interfere with or disrupt the Service or impose an unreasonable load on our infrastructure
Attempt to access other users' servers or data

We reserve the right to suspend or terminate your account for violation of these terms without prior notice or refund.

10. AI-Generated Content

The Service uses AI models provided by third parties. You acknowledge that:

AI-generated content may be inaccurate, biased, incomplete, or inappropriate
You are responsible for reviewing and verifying any AI output before relying on it
AI responses do not constitute professional advice (legal, medical, financial, etc.)
We are not liable for decisions made based on AI-generated content

11. Third-Party Services

The Service relies on third-party providers including Telegram, OpenRouter, Anthropic, OpenAI, Google, MoonshotAI, Minimax, Hetzner, Cloudflare, and Stripe. Your use of the Service is also subject to their respective terms. We are not responsible for the availability, performance, or policies of third-party services.

12. Intellectual Property

The Service, including its design, code, features, and branding, is the property of PlugAndClaw and is protected by applicable intellectual property laws. The underlying OpenClaw software is open-source and licensed separately under the MIT License.

You retain full ownership of any content you create or submit through the Service. By using the Service, you grant us a limited, non-exclusive licence to host and process your content solely for the purpose of providing the Service to you.

13. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any damages resulting from service interruptions.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLUGANDCLAW AND ITS AFFILIATES, OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to indemnify, defend, and hold harmless PlugAndClaw and its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

17. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Where possible, we will provide reasonable notice before termination unless the violation requires immediate action. Upon termination, your right to use the Service ceases immediately and your server will be deleted.

Any provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, and indemnification — shall survive.

18. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Nothing in these Terms limits any consumer rights you may have under mandatory provisions of the law in your country of residence.
